The demand for the reinstatement of Lee Young-joo, a former secretary-general of the Korean Confederation of Trade Unions (KCTU) and a member of the Korean Teachers and Education Workers' Union (KTU), continues to be voiced. This teacher legally regained her civil service reinstatement rights through a pardon in December 2021, but has not been able to return to the classroom even after about three years have passed.
On May 11, the National Association of Educational Workers held a press conference in front of the Sarangchae in Jongno-gu, Seoul, urging the immediate reinstatement of Lee Young-joo. The KTU criticized the reality that, despite legally regaining civil service reinstatement rights, she is still unable to return to the classroom, calling it an administrative neglect that undermines the purpose of the pardon.
Lee Young-joo has been involved in the education sector since her appointment at Tongyeong Middle School in 1980, and she participated in the establishment of the KTU in 1989. At that time, she was dismissed for her involvement in the founding of the KTU as the inaugural director of the Gyeongnam branch and was reinstated in 1998.
Even after reinstatement, she continued her activities with the KTU. From 2013 to 2014, she served as the senior vice-chair of the KTU, and in November 2014, she was elected as the 11th secretary-general of the 8th term of the KCTU. She was also the first female secretary-general of the KCTU.
However, in 2014, she was indicted for leading protests against the government's policy of excluding the KTU from legal labor unions and for activities such as declaring a teacher strike. She was then indicted in December 2017 for leading illegal and violent protests and was dismissed in 2019.
The KTU views the dismissal of Lee Young-joo not just as an individual issue but as a symbolic case where legitimate trade union activities and actions for the realization of democracy have led to dismissal.
The government pardoned and reinstated Lee Young-joo in December 2021, thereby restoring her legal civil service reinstatement rights. However, her reinstatement has not yet been realized.
The obstacle to reinstatement lies in Article 9 of the Education Civil Servants Appointment Order, which allows reappointment only within three years from the last retirement date, creating another barrier for teachers who have been dismissed for an extended period.
The KTU stated, "The relevant laws, including the Education Civil Servants Appointment Order, preventing the reinstatement of dismissed teachers, must be amended immediately," and emphasized that "it is unfair for a teacher who has regained legal rights through a pardon to be unable to return to the classroom due to administrative regulations."
At the press conference on May 11, Lee Young-joo defined her reinstatement struggle as "labor education by dismissed teachers."
She said, "I lived as a dismissed person for ten years. I thought it was okay," and stated, "At that time in 2015, I fought under the name of the KCTU to address the poor working conditions faced by students and young people, the KTU being excluded from legal labor unions, and the issues of the Sewol ferry disaster."
She continued, "Through the KCTU's general strike and the people's uprising, we fought against the labor repression of the Park Geun-hye government, the destruction of people's livelihoods, the erosion of democracy, the nationalization of Korean history textbooks, and the cover-up of the truth about the Sewol ferry disaster," and said, "I thought that by creating the resignation of Park Geun-hye with the citizens in the square, Korean society took a step forward in democracy. So, I thought my role was sufficient, but it was not enough."
She emphasized, "If one is dismissed for trade union activities, it is not a society that respects labor, and if one is dismissed for representing the voices of workers and citizens, it is not democracy."
Furthermore, she stated, "I will continue the reinstatement struggle to ensure that no one is dismissed for the same reasons," adding, "The reinstatement struggle is labor education by dismissed teachers and a democratic lesson conducted by teachers without classrooms."
She concluded, "I hope for the day when teaching in a classroom is no longer just a dream but a reality to come quickly," and said, "Only then will it be true democracy, only then will it be respect for labor, and that is justice."
"Responsibility for my dismissal and delayed reinstatement lies with the current government"
Lee Young-joo argued that the current government also bears responsibility for her dismissal and delayed reinstatement.
She said, "In the past, it was the Park Geun-hye government that issued a warrant for my arrest and detained me, but today, I am a dismissed person because of the current government's responsibility," adding, "The current government and Lee Jae-myung administration must answer what kind of country South Korea is today."
Her statement implies that the issue of delayed reinstatement after pardon and restoration of legal rights cannot be seen solely as a problem of past oppression by the previous administration. If reinstatement to the classroom is obstructed due to administrative and institutional barriers even after legal rights have been restored, the responsibility to resolve this lies with the current government and educational authorities.
"The torchbearer of the Candlelight Revolution, the people's uprising is innocent"
Lee Young-joo's reinstatement struggle is deeply connected to the historic significance of the Candlelight Revolution in 2016. Supporters are urging her reinstatement under the slogan, "The torchbearer of the Candlelight Revolution, the people's uprising is innocent."
The KCTU's general strike and the people's uprising in 2015 were popular resistance movements against the labor repression, people's livelihood crisis, retreat of democracy, nationalization of Korean history textbooks, and the cover-up of the truth about the Sewol ferry disaster by the Park Geun-hye government. Subsequently, citizens gathered in the square holding candles, leading to the impeachment of former President Park Geun-hye.
Lee Young-joo's reinstatement is not just about the restoration of one teacher's honor. It is about correcting anti-labor practices that lead to oppression and dismissal for legitimate union activities and social resistance.
"To return to the classroom before retirement next year"
Given that Lee Young-joo will reach retirement age next year, there is not much time left for her to be with students in the classroom until the end. Prompt reinstatement is necessary to allow her to finish her final teaching years with students.
Noh Byeong-seop, a former director of the KCTU's Jeonbuk branch, posted a photo on Facebook of himself participating in a picket with Lee Young-joo, stating, "Teacher Lee Young-joo must be reinstated," and said, "34 people were dismissed together due to the KTU's involvement in an illegal labor union, but only Teacher Lee Young-joo has not been able to return to the classroom yet." He further expressed, "She will reach retirement age next year," and appealed, "Much attention and solidarity are needed to allow her to finish her last teaching years with students."
He also mentioned, "Teacher Lee Young-joo was arrested and dismissed for leading the people's uprising, which was the torchbearer of the Candlelight Revolution," and pointed out, "Despite the pardon and restoration of rights, she has not been allowed to return to the classroom."
Reinstatement is not just an individual issue but a matter of democracy
The reinstatement of Lee Young-joo is not just about the restoration of one teacher's status. If labor union activities, representation of the rights of social minorities and citizens, and participation in the restoration of democracy lead to dismissal and exclusion, this goes against the society that the country seeks, which respects labor.
The demonstrators in front of the Blue House demanding Lee Young-joo's reinstatement state, "It is the minimum duty of the country to allow a teacher who has dedicated her life to realizing the values of education and labor to regain her honor and retire by the side of students."
Lee Young-joo said at the press conference, "A society where those who dedicate themselves to creating a better world do not suffer will progress a little faster," and expressed, "I hope my reinstatement will be a catalyst for one step forward in our society."
The issue of Lee Young-joo's reinstatement now goes beyond an individual's past events and remains a challenge for Korean society on how it will treat those who have dedicated themselves to labor union activities and democracy.
이영주 해직교사 “오늘 내가 해고자인 이유는 현 정부의 책임”
이영주 전 민주노총 사무총장이자 전교조 조합원인 이영주 교사의 복직을 요구하는 목소리가 계속 이어지고 있다. 이 교사는 2021년 12월 사면·복권을 통해 법적으로 공무담임권을 회복했으나, 약 3년이 지난 현재까지 교단으로 돌아가지 못하고 있다.
전국교직원노동조합은 5월 11일 서울 종로구 청와대 사랑채 앞에서 기자회견을 열고, 이영주 교사의 즉각 복직을 촉구했다. 전교조는 “법적으로 공무담임권은 회복했지만, 여전히 교단에 설 수 없는 현실은 사면·복권의 취지를 무색하게 만드는 행정적 방치”라며 현실을 비판했다.
이영주 교사는 1980년 통영여중에 처음 부임한 이후, 1989년 전교조 결성에 참여했다. 당시 초대 경남지부장을 맡았던 그는 전교조 창립에 동참했다는 이유로 해직됐고, 1998년에 복직했다.
복직 이후에도 전교조 활동을 이어왔다. 2013년부터 2014년까지 전교조 수석부위원장을 지냈고, 2014년 11월에는 민주노총 8기 11대 사무총장으로 선출되었다. 민주노총 최초의 여성 사무총장이기도 했다.
그러나 2014년 정부의 전교조 법외노조화 방침에 반발해 조퇴투쟁과 교사선언 등을 주도했다는 혐의로 2015년 불구속 기소됐다. 이어 2017년 12월에는 불법·폭력 시위를 주도한 혐의로 구속됐고, 2019년에 해고 처분을 받았다.
전교조는 이영주 교사의 해고가 단순히 개인의 문제가 아니라, 정당한 노동조합 활동과 민주주의 실현을 위한 행동이 해고로 이어진 상징적 사례라고 보고 있다.
정부는 2021년 12월 이영주 교사를 사면·복권했으며, 이를 통해 법적 공무담임권이 회복됐다. 그러나 복직은 아직도 이루어지지 않고 있다.
교육공무원임용령 제9조가 복직의 걸림돌이 되었다. 마지막 퇴직일로부터 3년 이내에만 재임용이 가능하게 되어 있어, 장기간 해직 상태였던 교사들에게는 또 다른 장벽이 되고 있다는 주장이다.
전교조는 “해직 교사의 복직을 막는 교육공무원임용령 등 관련 법령을 즉각 개정해야 한다”며 “사면·복권으로 법적 권리를 회복한 교사가 행정 규정 때문에 교단에 서지 못하는 것은 부당하다”고 밝혔다.
이영주 교사는 5월 11일 기자회견에서 자신의 복직 투쟁을 “해직교사가 하는 노동교육”이라고 정의했다.
그는 “10년 동안 해고자로 살았다. 그래도 괜찮다고 생각했었다”며, “2015년 당시 학생과 청년들이 마주하던 열악한 노동환경, 전교조 법외노조, 그리고 세월호 참사의 문제를 해결하고자 민주노총 이름으로 싸웠다”고 밝혔다.
이어 “민주노총 총파업과 민중총궐기를 통해 박근혜 정권의 노동개악, 민생파탄, 민주주의 파괴, 한국사 교과서 국정화, 세월호 진실 은폐에 맞서 싸웠다”며, “광장의 시민들과 함께 박근혜 퇴진을 만들어냈고, 한국 사회의 민주주의가 한 걸음 전진했다고 생각한다. 그래서 내 역할은 충분히 다한 줄 알았지만, 그것만으로는 부족했다”고 말했다.
그는 “노동조합 활동을 이유로 해고된다면 노동존중사회가 아니고, 노동자와 시민의 목소리를 대변했다는 이유로 해고된다면 민주주의도 아니다”라고 강조했다.
또한 “앞으로는 같은 이유로 해고되는 일이 없도록 복직 투쟁을 이어가겠다”며, “복직 투쟁은 해직교사가 하는 노동교육이며, 교실이 없는 교사가 진행하는 학교 밖 민주주의 수업”이라고 덧붙였다.
마지막으로 “교실 안 수업이 더 이상 꿈이 아닌 현실이 되는 날이 빨리 오길 바란다”며, “그래야 진정한 민주주의이고, 그래야 노동존중이며, 바로 그게 정의라고 믿는다”고 말했다.
“나의 해고와 복직 지연, 현 정부의 책임”
이영주 교사는 자신의 해고와 복직 지연에 대한 책임이 현 정부에도 있다고 주장했다.
그는 “과거에 나를 수배하고 구속시킨 건 박근혜 정권이었지만, 오늘 내가 해고자인 것은 현 정부의 책임”이라며, “지금의 한국은 어떤 나라인지, 이재명 정부는 반드시 답해야 한다”고 말했다.
이 발언은 사면과 복권 이후에도 여전히 복직이 이뤄지지 않는 현실을 더는 과거 정권의 탄압 문제로만 볼 수 없다는 뜻으로 해석된다. 법적 권리가 회복된 후에도 행정적·제도적 장벽 때문에 교단 복귀가 가로막혀 있다면, 이를 해결할 책임은 현 정부와 교육당국에 있다는 주장이다.
“촛불항쟁의 마중물, 민중총궐기는 무죄”
이영주 교사의 복직 투쟁은 2016년 촛불항쟁의 역사적 의미와도 깊게 연결돼 있다. 지지자들은 “촛불항쟁의 마중물, 민중총궐기는 무죄다”라는 구호 아래 이 교사의 복직을 촉구하고 있다.
2015년 민주노총의 총파업과 민중총궐기는 박근혜 정권의 노동개악, 민생 파탄, 민주주의 후퇴, 한국사 교과서 국정화, 세월호 참사 진실 은폐에 맞선 대중적 저항이었다. 이후 시민들이 광장에 모여 촛불을 들면서 박근혜 전 대통령의 탄핵으로 이어졌다.
이영주 교사의 복직이 단순히 개인의 명예 회복에 그치지 않는다. 정당한 노조 활동과 사회적 저항이 탄압이나 해고로 이어지는 반노동적 관행을 바로잡아야 한다.
“내년 정년 전 교단으로 돌아가야”
이영주 교사가 내년에 정년을 맞는다는 점에서도 남은 시간이 많지 않은 만큼, 마지막까지 학교 현장에서 학생들과 함께할 수 있도록 조속한 복직이 필요하다.
전교조 전북지부장를 지냈던 노병섭 민주노총 전 전북본부장은 이영주 교사와 함께 피켓시위를 가진 사진을 페이스북에 포스팅 하며 “이영주 선생님은 반드시 복직되어야 한다”며, “전교조 법외노조 관련으로 34명이 함께 해직됐다가 모두 복직되었지만, 유독 이영주 선생님만은 아직 교단으로 돌아가지 못하고 있다”고 밝혔다. 이어 “내년이면 정년을 맞이한다”며 “마지막 교직 생활을 학생들과 함께 마무리할 수 있도록 많은 관심과 연대가 필요하다”고 호소했다.
또한 “이영주 선생님은 촛불항쟁의 마중물이었던 민중총궐기를 이끌었다는 이유로 구속과 해직을 겪었다”며 “사면과 복권이 이뤄졌음에도 불구하고 아직 복직이 허락되지 않고 있다”고 지적했다.
복직은 개인 문제가 아니라 민주주의의 문제
이영주 교사의 복직이 한 교사의 신분 회복에만 그치지 않는다. 노동조합 활동이나 사회적 약자, 시민의 권리를 대변하는 행동, 민주주의 회복을 위한 참여가 해고와 배제로 이어진다면 이는 국가가 추구하는 노동존중 사회와는 거리가 멀다.
이영주 교사의 복직을 요구하는 청와대 앞 시위자들은 "평생을 교육과 노동의 가치 실현에 헌신한 교사가 본인의 명예를 되찾고 학생들 곁에서 퇴임할 수 있도록 하는 것은 국가의 최소한의 도리”라고 밝히고 있다.
이영주 교사는 기자회견에서 “더 나은 세상을 만들기 위해 헌신한 이들이 피해를 보지 않은 사회가 조금 더 빨리 나아질 것”이라며 “내 복직이 우리 사회 한걸음 전진의 계기가 되길 바란다”고 말했다.
이영주 교사의 복직 문제는 이제 한 개인의 과거 사건을 넘어, 한국 사회가 노동조합 활동과 민주주의를 위해 헌신한 이들을 어떻게 대우할 것인가라는 과제로 남아 있다.
