Two Faces of Politicians: Superintendent of Education and Politicians, Constitution Prohibits

The argument that politicians should not become superintendents of education can be based on Article 31, Paragraph 4 of the Constitution of the Republic of Korea. The Constitution states that "the autonomy, expertise, and political neutrality of education shall be guaranteed in accordance with the law." This is a constitutional principle aimed at separating education from political power and preserving its inherent value.

However, in the current educational landscape in our country, these principles are being shaken in various ways. On one hand, politicians are trying to take on the role of superintendent of education, while on the other hand, there is a phenomenon known as 'polititization' where teachers use the classroom as a stepping stone for active political involvement. Although these may seem like different issues on the surface, both cases fundamentally transform education into a tool of politics.

Just looking at the 'phone-free school' policy proposed by the recently elected Gyeonggi Province Superintendent of Education, An Min-seok, it is evident how easily politicians can use education as a slogan. The school-wide ban on smartphones is a too simplistic regulation that does not properly reflect the daily lives and rights of students, as well as the complex realities of school environments. As pointed out by the Youth Committee of the Labor Party, smartphones are closely linked to various aspects of students' lives such as classes, access to information, recording in crisis situations, and safety, and are not just simple entertainment tools. If change is necessary, a process where students, teachers, and parents discuss and agree together must precede any decisions. Issuing blanket prohibitions through administrative orders on such matters is not desirable.

It is a clear contradiction to claim to uphold democracy and progressivism while limiting students' basic rights, and emphasizing debate education while introducing prohibitive policies without sufficient discussion with students. Ultimately, this is more of a political showmanship rather than substantive educational policy.

The issue of polititization is not fundamentally different. Current teachers standing on the stage of specific political events, using educational issues for political leverage, and turning the classroom, a public space, into a tool for their political capital seriously undermines the political neutrality of education. Students may find it difficult to express their opinions freely in the face of teachers' political statements, and political instigation in the classroom can infringe not only on students' right to education but also on their freedom of thought.

When politicians become superintendents of education, education policies become subservient to political slogans, and polititization brings political frames into the classroom. Politicians use education for political gains, while polititization uses the classroom as a tool to expand their political influence.

Education should be entrusted to those with expertise in education, while politics should be handled by those capable of political responsibility. The position of superintendent of education is not a space for politicians to build their careers, and the classroom is not a stage for teachers to enter into politics. Only when politicians relinquish the position of superintendent of education and polititization stays out of the classroom, will our education system truly regain the autonomy, expertise, and political neutrality guaranteed by the Constitution.

정치인 교육감과 폴리티처, 헌법이 금한 두 얼굴

안민석 논란이 증명한 것, 정치인도 정치인 나름이겠지만...

정치인이 교육감이 되어서는 안 된다는 주장은 대한민국 헌법 제31조 제4항에 근거를 둘 수 있다. 헌법은 “교육의 자주성, 전문성, 정치적 중립성은 법률이 정하는 바에 따라 보장된다”고 명시하고 있다. 이는 교육을 정치 권력에서 분리하고, 본연의 가치를 지키기 위한 헌법적 원칙이다.

그러나 현재 우리 교육 현장에서는 이러한 원칙이 다양한 방식으로 흔들리고 있다. 한편으로는 정치인이 교육감 자리에 오르려 하고, 다른 한편에서는 교사가 본격적인 정치 진출의 발판으로 교실을 활용하는 이른바 ‘폴리티처’ 현상도 나타난다. 겉으로 보기에는 서로 다른 문제처럼 보이지만, 두 경우 모두 교육을 정치의 수단으로 전락시킨다는 점에서 근본적으로 같다.

최근 안민석 경기도교육감 당선인이 제시한 ‘폰프리스쿨’ 정책만 봐도, 정치인이 교육을 얼마나 손쉽게 구호로 소비하는지 확인할 수 있다. 교내 스마트폰 전면 금지 방침은 학생들의 일상과 권리, 학교 현장의 복잡한 현실을 제대로 반영하지 못한 너무 단순한 규제다. 노동당 청소년위원회에서도 지적했듯, 스마트폰은 단순한 오락 도구가 아니라 수업, 정보 접근, 위기 상황에서의 기록과 안전 등 학생 생활 전반과 밀접하게 연결돼 있다. 만약 변화가 필요하다면, 학생·교사·학부모가 함께 충분히 논의하고 합의하는 절차가 반드시 선행되어야 한다. 이러한 사안을 행정명령으로 일괄 금지하는 것은 바람직하지 않다.

민주와 진보를 내세우면서 정작 학생 기본권은 제한하고, 토론 교육을 강조하면서도 학생들과 충분한 논의 없이 금지 정책부터 도입하는 태도는 분명한 모순이다. 결국 이는 실질적인 교육정책이라기보다는 정치적 보여주기에 가까운 행위다.

폴리티처 문제도 본질적으로 다르지 않다. 현직 교사가 특정 정치 행사의 무대에 서거나, 교육 현안을 정치적으로 활용하고, 교실이라는 공적 공간의 영향력을 자신의 정치 자산으로 바꾸려는 행동은 교육의 정치적 중립성을 심각하게 훼손한다. 학생들은 교사의 정치적 발언 앞에서 자유롭게 의견을 밝히기 어려워질 수 있으며, 교단 위에서의 정치 선동은 단순한 의견 개진을 넘어 학생들의 교육받을 권리와 사고의 자유까지 침해할 수 있다.

정치인이 교육감이 되면 교육정책이 정치 구호에 종속되고, 폴리티처는 교실 안으로 정치적 프레임을 들여온다. 정치인은 교육을 표 계산의 수단으로 삼고, 폴리티처는 교실을 자신의 정치적 영향력 확대의 도구로 이용한다.

교육은 교육의 전문성을 갖춘 이가 맡아야 하며, 정치는 정치적 책임을 질 수 있는 이가 담당해야 한다. 교육감 자리도 정치인의 경력을 쌓기 위한 공간이 아니고, 교실 역시 교사의 정치 입문 무대가 아니다. 정치인은 교육감 자리를 내어놓고, 폴리티처는 교실로 들어오지 않을 때, 비로소 우리 교육은 헌법이 보장하는 자주성, 전문성, 정치적 중립성을 제대로 되찾게 될 것이다.
