A part-time teacher who worked at a middle school in Iksan, North Jeolla Province, has been handed over to trial on charges of repeatedly sexually assaulting a female student.
The Jeonju District Prosecutors' Office in Gunsan (led by Chief Prosecutor Hong Ji-ye) announced on August 14 that a man in his 40s, referred to as Mr. A, has been arrested and indicted on charges of violating the Act on the Protection of Children and Juveniles against Sexual Violence.
According to the prosecution, Mr. A is accused of raping or molesting student B, who was attending the middle school where he worked, around 20 times over a period of approximately two months before and after last summer vacation. The prosecution determined that Mr. A committed the crimes taking advantage of his position and influence as a teacher.
During the investigation, the police believed there was consent between the two individuals, so they referred the case to the prosecution applying charges of statutory rape of a minor to Mr. A. However, a decision of non-indictment was made regarding some of the charges Mr. A denied.
Nevertheless, the prosecution requested the police to conduct further investigation and after receiving the entire crime report, they proceeded with supplementary investigations. After interviewing additional victims and reviewing relevant legal principles, they concluded that the crimes were committed due to the influence stemming from the relationship between a teacher and a student, regardless of formal consent.
As a result, the prosecution changed Mr. A's charges from statutory rape of a minor to sexual assault based on abuse of power and influence under the Act on the Protection of Children and Juveniles against Sexual Violence. While the statutory rape of a minor carries a minimum sentence of three years in prison, sexual assault on children and juveniles due to abuse of power and influence can lead to life imprisonment or a minimum of five years in prison.
The prosecution conducted a search and seizure at Mr. A's residence and confirmed an additional seven cases of crimes that were previously unidentified during the process of analyzing his mobile phone and base station location.
Taking into consideration the relationship between the teacher and student, the frequency of the crimes, and the possibility of evidence tampering, the prosecution requested a warrant for Mr. A's arrest. With the court issuing the warrant, Mr. A is now in custody awaiting trial.
A prosecution official stated, "We will respond strictly to sexual crimes against children and juveniles and make every effort to protect the victims."
익산 중학교 기간제 교사, 여중생 제자 성폭행 혐의로 구속기소
전북 익산의 한 중학교에서 근무했던 기간제 교사가 여학생 제자를 여러 차례 성폭행한 혐의로 재판에 넘겨졌다.
전주지검 군산지청 형사2부(부장검사 홍지예)는 8월 14일 아동·청소년의 성보호에 관한 법률 위반 혐의로 40대 남성 A씨를 구속기소했다고 밝혔다.
검찰에 따르면 A씨는 지난해 여름방학을 전후한 약 두 달 동안 자신이 근무하던 중학교에 재학 중인 B양을 20여 차례 간음하거나 추행한 혐의를 받는다. 검찰은 A씨가 교사라는 지위와 영향력을 이용해 범행한 것으로 판단했다.
경찰은 수사 당시 두 사람 사이에 합의가 있었던 것으로 보고 A씨에게 미성년자의제강간 혐의를 적용해 사건을 검찰에 넘겼다. A씨가 부인한 일부 혐의에 대해서는 불송치 결정을 내렸다.
그러나 검찰은 경찰에 재수사를 요청해 고소된 범죄사실 전체를 넘겨받은 뒤 보완수사를 진행했다. 피해 학생을 추가로 조사하고 관련 법리를 검토한 결과, 형식적인 동의 여부와 관계없이 교사와 학생이라는 관계에서 발생한 위력에 의한 범행이라고 판단했다.
이에 따라 검찰은 A씨의 혐의를 미성년자의제강간에서 아동·청소년의 성보호에 관한 법률상 위계·위력 등에 의한 간음 혐의로 변경했다. 미성년자의제강간죄의 법정형은 3년 이상의 징역이지만, 아동·청소년에 대한 위계·위력 간음죄는 무기징역 또는 5년 이상의 징역으로 처벌할 수 있다.
검찰은 A씨의 주거지를 압수수색하고 휴대전화 기지국 위치 등을 분석하는 과정에서 수사기관이 기존에 파악하지 못했던 범행 7건도 추가로 확인했다고 밝혔다.
검찰은 교사와 학생이라는 관계, 범행 횟수와 증거인멸 가능성 등을 고려해 A씨에 대한 구속영장을 청구했다. 법원이 영장을 발부하면서 A씨는 구속 상태로 재판을 받게 됐다.
검찰 관계자는 “아동·청소년을 대상으로 한 성범죄에 엄정하게 대응하고 피해자 보호에도 최선을 다하겠다”고 밝혔다.
