The number of specialized lawyers for school authority and school violence in the regime of Cheon Ho-sung, the superintendent of education in Jeonbuk, has decreased compared to before. However, the issue is not simply about how many have been reduced. It is necessary to evaluate whether the current system of continuously deploying specialized lawyers should be maintained.
During the tenure of former Superintendent Seo Geu-seok, the Jeonbuk Office of Education expanded its legal staff, including four specialized lawyers for school violence and two for school authority. Subsequently, the staff was reduced, but the basic structure of having specialized lawyers to legally address school conflicts remains intact.
There are certainly cases in school settings where legal support is needed. However, if every conflict is approached from a legal perspective from the outset, there is a risk of expanding issues that could be resolved educationally into the realms of accusations and lawsuits. Especially, if a case later ends in acquittal or non-prosecution during the investigation process, it is difficult to reverse the damage if students and parents have already been stigmatized as victims of 'malicious complaints' or 'violation of school authority.'
Legal advice can be adequately provided through legal consultants or external specialized institutions. Rather than maintaining a permanent specialized staff, receiving independent legal reviews only for necessary cases and strengthening the functions of mediation and arbitration at school sites may be more suitable for resolving educational conflicts.
The reduction in staff by Superintendent Cheon can be seen as a step back from the previous indiscriminate expansion. However, that alone is not sufficient. An objective evaluation should first be made on how much the existing specialized lawyer system has actually contributed to protecting school authority, and conversely, whether it has escalated unnecessary legal disputes.
It is necessary to reconsider not just stopping at reducing the number of specialized lawyers, but also whether the continuous specialized system should be maintained. The core of protecting school authority lies not in the number of lawyer staff, but in how fairly and educationally school conflicts are resolved.

천호성 전북교육감 체제에서 교권·학교폭력 전담 변호사 인력이 이전보다 줄어들었다. 그러나 문제는 단순히 몇 명을 줄였느냐가 아니다. 전담 변호사를 상시 배치하는 현재의 제도 자체를 계속 유지할 필요가 있는지부터 따져봐야 한다.
전북교육청은 서거석 교육감 시절 학교폭력 전담 4명, 교권 전담 2명 등 변호사 인력을 확대해 운영했다. 이후 인력을 감원했지만 전담 변호사를 두고 학교 갈등에 법률적으로 대응하는 기본 구조는 그대로 유지되고 있다.
학교 현장에서 법률 지원이 필요한 경우는 분명 존재한다. 그러나 모든 갈등을 초기부터 법률적 사안으로 접근할 경우 교육적으로 해결할 수 있는 문제까지 고발과 소송의 영역으로 확대될 위험이 있다. 특히 이후 수사 과정에서 무혐의나 불송치로 끝나는 사건이라도 학생과 학부모가 이미 ‘악성민원’이나 ‘교권침해’ 당사자로 낙인찍혔다면 그 피해를 되돌리기 어렵다.
법률 자문은 고문변호사나 외부 전문기관을 통해서도 충분히 제공할 수 있다. 상시 전담 인력을 유지하는 것보다 필요한 사건에 한해 독립적인 법률 검토를 받고, 학교 현장에서는 조정과 중재 기능을 강화하는 것이 오히려 교육적 갈등 해결에 적합할 수 있다.
천 교육감이 인력을 감원한 것은 이전의 무분별한 확대에서 한발 물러선 조치로 볼 수 있다. 하지만 그것만으로 충분하지 않다. 기존 전담 변호사 제도가 실제 교권 보호에 얼마나 기여했는지, 반대로 불필요한 법적 분쟁을 키우지는 않았는지 객관적인 평가가 먼저 이뤄져야 한다.
전담 변호사의 숫자를 줄이는 데서 그칠 것이 아니라, 상시 전담 체제를 계속 유지해야 하는지까지 재검토해야 한다. 교권 보호의 핵심은 변호사 인력이 아니라 학교 갈등을 얼마나 공정하고 교육적으로 해결하느냐에 있다.
