Jeonbuk Teachers' Union: "Clarify the Title of Education Human Rights Protection Officer and Authority of Dispatched Teachers"

The Jeonbuk Special Self-Governing Province Teachers' Association Federation demanded that the Jeonbuk Provincial Office of Education clarify the position, authority, and command structure of the dispatched teachers from the Jeonbuk Education Human Rights Center.

On the 7th, the Jeonbuk Teachers' Association issued a statement stating, "The position, title, authority, and command structure related to the operation of dispatched teachers from the Jeonbuk Education Human Rights Center are not clearly communicated to schools," and argued that the basis for using the title 'Education Human Rights Protector' and the scope of duties of dispatched teachers should be clearly defined.

The Jeonbuk Teachers' Association emphasized that as the Education Human Rights Center deals with sensitive issues such as violations of educational rights, child abuse reports, school violence, and student rights, it is essential for the actual position, authority, and command structure of the personnel visiting schools to be clear.

In particular, the Jeonbuk Teachers' Association explained that the Education Office has a system where a Grade 5 equivalent Education Rights Protector, the center director, scholarship officer, legal support staff, etc., divide roles to handle cases of educational rights violations and support for affected teachers.

According to the Jeonbuk Teachers' Association, there have been cases where Education Human Rights Center officials visiting schools were mistaken for 'scholarship officers' by the school staff, leading to confusion.

The Jeonbuk Teachers' Association stated, "This is not a problem that can be overlooked as a mere misunderstanding in expression," and expressed that in cases of educational rights violations, confusion may arise in schools if the position and authority of the personnel are unclear, as it can lead to issues ranging from protecting affected teachers and responding to students and parents, to legal disputes and determining whose judgment the school should follow.

The Jeonbuk Teachers' Association also claimed that there have been instances where dispatched teachers from the Education Human Rights Center introduced themselves as 'Education Human Rights Protectors' in external communications. The association explained that such messages included statements like "Became an Education Human Rights Protector as of September 1" along with a commitment to listen to the opinions of schools and teachers facing difficulties due to educational rights violations.

The Jeonbuk Teachers' Association demanded transparency regarding the basis for the title 'Education Human Rights Protector' within the Jeonbuk Education Office's official system, stating that if dispatched teachers use this title separate from the existing 'Education Rights Protector' system, the basis and scope of authority of the title should be disclosed.

However, the association clarified that they do not have an issue with experienced teachers being dispatched to the Education Office.

Jeonbuk Teachers' Association Chairman Oh Jun-young stated, "Jeonbuk already has a system in place for handling educational rights protection centered around Grade 5 equivalent Education Rights Protectors," and added, "In such a situation, if dispatched teachers use a title like 'Education Human Rights Protector' without clear justification and are mistakenly perceived at the school level to have the same authority as existing Education Rights Protectors or scholarship officers, it can lead to confusion."

He further emphasized, "In cases of educational rights violations, what is important at the scene is not just a plausible title but accurate legal support, a clear responsibility system, and prompt protective measures," and urged the Jeonbuk Education Office to transparently clarify the name and organizational operation of the Education Human Rights Center, the duties and command structure of dispatched teachers, and resolve confusion at the scene.

The Jeonbuk Teachers' Association demanded official guidance from the Jeonbuk Education Office on the use of the title 'Education Human Rights Protector,' along with the disclosure of the legal and administrative basis, differentiation of roles between existing Education Rights Protectors and dispatched teachers, accurate positions and duties of dispatched teachers, and notification of school visit rights.

The association also argued for the disclosure of the command and responsibility system among the center director, Education Rights Protectors, scholarship officers, lawyers, and dispatched teachers, and clear notification of the actual position, purpose of the visit, and scope of authority of the personnel to both affected teachers and schools during school visits.

The Jeonbuk Teachers' Association stated, "At the moment the educational rights protection system causes confusion at the scene, affected teachers may once again become anxious," and declared, "We will continue to respond until a reliable educational rights protection system that affected teachers can trust is established."

전북교총 “교육인권보호관 명칭·파견교사 권한 근거 밝혀야”

전북특별자치도교원단체총연합회가 전북교육인권센터 파견교사의 직위와 권한, 지휘체계를 명확히 공개할 것을 전북특별자치도교육청에 요구했다.

전북교총은 7일 입장문을 내고 “전북교육인권센터 파견교사 운영과 관련해 직위와 명칭, 권한, 지휘체계가 학교 현장에 명확히 안내되지 않고 있다”며 “‘교육인권보호관’이라는 명칭을 사용하는 근거와 파견교사의 업무 범위를 분명히 밝혀야 한다”고 주장했다.

전북교총은 교육인권센터가 교권침해와 아동학대 신고, 학교폭력, 학생인권 등 민감한 사안을 다루는 만큼 학교를 방문하는 담당자의 실제 직위와 권한, 지휘체계가 명확해야 한다고 강조했다.

특히 전북교육청에는 기존에 5급 상당 교권보호관을 중심으로 센터장과 장학사, 법률지원 인력 등이 역할을 나눠 교권침해 사안과 피해교원 지원 업무를 담당해온 체계가 있다고 설명했다.

전북교총은 이런 상황에서 파견교사가 ‘교육인권보호관’ 또는 ‘보호관’으로 소개되거나 학교 현장에서 기존 교권보호관과 유사한 권한을 가진 담당자로 받아들여질 경우 혼선이 생길 수 있다고 지적했다.

전북교총에 따르면 최근 한 학교의 교권침해 사안과 관련해 교육인권센터 관계자가 학교를 방문한 뒤 학교 측에서 방문자를 ‘장학관’으로 이해한 사례도 접수됐다.

전북교총은 “단순한 표현상의 착오로 넘길 문제가 아니다”며 “교권침해 사안은 피해교원 보호조치와 학생·학부모 대응, 교권보호위원회 절차, 향후 법적 분쟁까지 이어질 수 있어 담당자의 직위와 권한이 불분명할 경우 학교가 누구의 판단을 어디까지 따라야 하는지 혼란을 겪을 수 있다”고 밝혔다.

또 교육인권센터 파견교사가 대외 메시지에서 자신을 ‘교육인권보호관’이라고 소개한 사례도 있다고 주장했다. 해당 메시지에는 “9월 1일로 교육인권보호관이 되었다”는 표현과 함께 교권침해로 어려움을 겪는 학교와 교원들의 의견을 듣겠다는 내용이 포함됐다는 게 전북교총 설명이다.

전북교총은 “‘교육인권보호관’이라는 명칭이 전북교육청 직제상 어떤 근거를 가진 직위인지 명확하지 않다”며 “기존 ‘교권보호관’ 체계와 별도로 파견교사가 이 명칭을 사용한다면 명칭의 근거와 권한 범위를 공개해야 한다”고 요구했다.

다만 현장 경험을 가진 교사가 교육청에 파견되는 것 자체를 문제 삼는 것은 아니라고 선을 그었다.

전북교총은 “현장을 아는 교원의 목소리는 교육청 안에서도 필요하다”면서도 “파견교사가 교권침해 사안에 직접 관여하고 기존 교권보호관 체계와 구분되지 않는 명칭을 사용하면서 현장에서 권한이 과대하게 인식될 수 있다면 문제는 달라진다”고 밝혔다.

오준영 전북교총 회장은 “전북에는 이미 5급 상당 교권보호관을 중심으로 한 교권보호 업무 체계가 운영돼 왔다”며 “그런 상황에서 파견교사가 ‘교육인권보호관’이라는 직제상 근거가 불분명한 명칭을 사용하고 학교 현장에서 기존 교권보호관이나 장학관급 권한으로 오인될 수 있다면 현장은 혼란스러울 수밖에 없다”고 말했다.

이어 “교권침해 현장에서 중요한 것은 그럴듯한 명칭이 아니라 정확한 법률지원과 분명한 책임체계, 신속한 보호조치”라며 “전북교육청은 교육인권센터의 명칭과 조직 운영, 파견교사의 업무 범위와 지휘체계를 투명하게 밝히고 현장의 혼선을 해소해야 한다”고 강조했다.

전북교총은 전북교육청에 ‘교육인권보호관’ 명칭 사용의 직제·행정상 근거 공개와 함께 기존 교권보호관과 파견교사의 역할 구분, 파견교사의 정확한 직위와 업무 범위, 학교 방문 권한 등에 대한 공식 안내를 요구했다.

또 센터장과 교권보호관, 장학사, 변호사, 파견교사 간 지휘·책임체계를 공개하고 학교 방문 시 담당자의 실제 직위와 방문 목적, 권한 범위를 피해교원과 학교 측에 명확히 고지해야 한다고 주장했다.

전북교총은 “교권보호 체계가 현장에 혼란을 주는 순간 피해교원은 또 한 번 불안해질 수 있다”며 “피해교원이 믿고 기댈 수 있는 교권보호 체계가 마련될 때까지 대응하겠다”고 밝혔다.
